New California Law Mandates Employer Notification of Possible COVID-19 Exposure to Employees

On Thursday, September 17, 2020, the governor of California signed AB 685, a new law which requires public and private employers in the state to supply written notification to any employees, subcontractors, or employee’s exclusive bargaining representative who “may have been exposed” to COVID-19 in the workplace. In the notification, employers must include employees’ entitled benefits as a result of possible exposure and employer’s next steps to disinfect and provide for safety in the future. The law also discusses outbreak notification requirements, the Division of Occupational Safety Hazard’s (OSHA’s) authority, and implementation timeframes for the new law.
